Russian court awards apartment owners 15 million rubles over defects

Russian court awards apartment owners 15 million rubles over defects

A family bought a newly built apartment in 2013 in Kemerovo region.

Cold, damp conditions and cracks made most of the home difficult to use, and an expert later found serious, irreparable defects in the wall panels.

An appeal court had rejected the owners’ claim because it said the time limit had passed.

The Russian Supreme Court said the cracks alone did not prove the owners already knew the defects were serious, and the time limit had to be counted from when the apartment was handed to the buyers, not an investor.

On reconsideration, the regional court awarded two owners 15,094,479 rubles for the apartment, penalties, losses, a fine and moral harm.

The case shows that serious construction defects may still support a claim years later.

The sources give no further steps in the case.
