Gurugram gym members win Rs 25,500 in overcrowding consumer case
A gym in a city in India promised some people that it would not be too crowded, and that they could use the exercise machines easily in the evening.
Two people paid money for a four-month gym membership.
But when they went to the gym, it was very crowded, and they had to wait in long lines to use the machines.
The gym workers did not help them, and the gym would not give their money back.
So the two people complained to a special court called a consumer commission.
The court said the gym had not kept its promise, which is called a deficiency in service.
Because the gym did not come to the court to explain, the court believed the customers.
The gym has to give back the membership money, pay extra money for the stress the customers felt, and pay for the court costs.
That adds up to Rs 25,500.
This teaches businesses that they must keep their promises to customers.
The Gurugram District Consumer Commission ordered a gym to refund Rs 10,000 to two members who found it overcrowded despite being promised quiet evening workouts.
The gym must also pay Rs 10,000 for mental harassment and Rs 5,500 in litigation costs, bringing the total award to Rs 25,500.
The commission found a deficiency in service after the gym failed to appear and was proceeded against ex parte on January 21, 2025.
The complainants, working professionals, paid Rs 10,000 for a four-month membership starting April 17, 2024, but faced long queues for equipment.
The membership refund carries interest at 5 per cent per annum from September 3, 2024, the date the complaint was filed.
