TG REAT Upholds Refund Order Against Amacon Developers
A couple named Sandeep Kumar and Shipali wanted to buy a piece of land in a place called DLF Garden City.
They paid almost all the money for it, but the company they paid, Amacon Developers, did not give them the official paper that proves they own the land.
The company kept delaying and later sold the same land to someone else.
The couple got upset and asked a special housing court called RERA to help them.
RERA told the company to give all the money back, plus extra money called interest.
The company did not want to do that, so it appealed to a higher court called the Real Estate Appellate Tribunal.
The higher court agreed with RERA and said the company must pay back the money.
The court also said the company was acting like the main seller, not just a helper.
The person who bought the land later did not have to pay anything because he did not know about the first deal.
So the couple will get their money back with interest from the day they first paid.
Telangana Real Estate Appellate Tribunal upheld TG RERA's order directing Amacon Developers to refund Rs 36.58 lakh to a couple.
Sandeep Kumar and Shipali paid Rs 36.58 lakh of the Rs 37.38 lakh sale price for a plot in DLF Garden City but never received the registered sale deed.
The tribunal rejected Amacon's claim that it acted only as an agent and held that it acted as a promoter.
The tribunal found no evidence that the third-party purchaser knew about the earlier agreement, so he was not held liable.
The refund carries 10.75 per cent annual interest calculated from April 9, 2021.
