Bombay High Court Reinstates TISS Professor, Awards 50% Back Wages
Bombay High Court reinstates TISS professor fired for ‘misconduct’, grants 50% back wages · indianexpress.com

Dr Swapan Garain was a professor at the Tata Institute of Social Sciences.

TISS said he made a WhatsApp group to share job and career information without permission.

The institute also said he used its logo and was trying to run a placement business for personal gain.

Garain said he had only shared career information with former students.

The Bombay High Court examined the WhatsApp messages and the allegations.

It found no proof that he had received personal financial benefit.

The court said simply making or joining a WhatsApp group was not enough to justify such a severe punishment.

It therefore reinstated Garain and ordered TISS to pay him 50% of his lost wages.

Quotes

Justices M S Karnik and Sandesh D Patil

Bombay High Court judges who heard Garain’s reinstatement plea

“WhatsApp being a social media platform, merely starting a WhatsApp group and being a member of the WhatsApp group without there being further finding of any personal gain diverted to the benefit of the Petitioner, in our view, the punishment of ‘voluntary retirement’ is grossly disproportionate.”

The institute that brought the disciplinary allegations against Garain

“The WhatsApp group created by the petitioner was nothing but, virtually a placement service, soliciting students and alumni for his personal gains.”
