A division bench of Justices Ravinath Tilhari and Ch. Purushottama Kumar questioned why the police had not filed the counter affidavit for so long.
Vijayalakshmi, Sai Krishna's mother, had filed the habeas corpus petition seeking her son's production before the court; his custodial death at Krishna Lanka police station was subsequently confirmed.
The court rejected the government pleader's request for two weeks' time and adjourned the matter to August 20.
The SIT has arrested another police constable in the case, and a bench headed by Chief Justice Lisa Gill adjourned a PIL seeking transfer of the case to the CBI.
