Italian condo fines require rules and an owners’ assembly vote

In Italy, disputes between neighbours in a condominium can involve noise or water dripping from laundry onto another balcony.

The condominium administrator is not responsible for resolving these individual disputes because they do not concern shared property.

The administrator should check whether the building’s rules explicitly prohibit the conduct.

If the rules do not provide for a fine, the administrator can remind residents to follow them but cannot impose a penalty.

If a fine is provided for, the amount must be put to a vote at the next suitable owners’ assembly.

Under the rules described, fines can range from 200 euros to 800 euros for repeated violations.

The decision needs the support of owners at the meeting who represent at least 500 thousandths of the building’s ownership shares.
