German teachers can intervene to stop danger, but must act proportionately

Denmark is considering a law that would clearly allow teachers to use physical force in exceptional situations, such as restraining a student or ending a dangerous incident.

The debate has raised questions about what teachers may do in Germany.

There is no specific German law spelling out a power to restrain or remove students, but teachers may rely on their duty to supervise and on rules allowing people to defend themselves or others.

They can intervene to stop violence, protect students or prevent damage, but their actions must be necessary and proportionate.

Physical force is not allowed just because a student is noisy or disruptive, and teachers have no right to punish students physically or unlawfully confine them.

Germany’s teachers’ association says the rules are broadly sufficient but wants better training so staff know how to act in crises.

Hamburg’s education senator opposes expanding teachers’ powers and says schools should focus on preventing and addressing violence using existing measures.
