Türkiye draft law would set rules for troubled fund liquidations

Lawmakers from Türkiye’s ruling AKP have drafted a proposal for investors affected by troubled investment funds.

It aims to identify fund assets and their owners, sell assets while limiting losses, and distribute the proceeds fairly.

The proposal covers 455,578 investors and assets worth up to 1 million Turkish lira per investor.

It would allow interim payments, capped at the investor’s net investment or finalized claim, and divide available cash proportionally if there is not enough for everyone.

The Capital Markets Board would set payment priorities, which could favor investors with smaller net investments.

The draft also includes a voluntary repayment process for people who left funds early and received returns considered unusually high because of inaccurate asset valuations.

Fund founders, managers and others found responsible for shortfalls could be held liable, and seized assets could help compensate investors.

The proposal is expected to go to parliament in the coming days.
