NCDRC Grants Interim Relief in Alta Monte Flat Dispute
Homebuyers complained that developers had not given them their promised flats on time.
A consumer commission earlier ordered the developers to complete the sale agreements and hand over the flats.
It also ordered interest and other payments in at least one case.
The developers appealed that decision to the National Consumer Disputes Redressal Commission.
The NCDRC has temporarily paused some steps related to handing over possession.
This pause lasts only until the next hearing and is not a final decision.
ERA Realtors must place the required money with the commission within four weeks.
The money will be kept in a fixed deposit at a nationalised bank.
The case will be heard again on October 29.
The NCDRC admitted appeals by ERA Realtors and Omkar Realtors over Alta Monte flats.
It temporarily restricted execution of possession-related directions from the Maharashtra State Consumer Commission.
ERA Realtors must deposit the entire decretal amount, less amounts already deposited, within four weeks.
The State Commission had ordered possession, registered sale agreements, occupancy certificates, amenities, interest, compensation and costs.
The next hearing is scheduled for October 29, when delay-condonation applications will be considered first.
