Insurer Cannot Reject Claim Over Unrelated Tax Issue
Can an insurer reject your claim over a tax issue? Consumer panel answers · livemint.com

A court in Rajasthan's Sirohi has ruled that an insurance company cannot reject a claim just because of a tax issue that is not related to the claim.

The insurer, New India Assurance, had rejected a claim because of a tax discrepancy, but the court said that the insurer must show a clear link between the reason for rejecting the claim and the terms of the insurance policy or the loss suffered by the policyholder.

The ruling does not mean that insurers cannot check documents or verify compliance while processing claims, but any discrepancy found must be relevant to the insurance contract, the nature of the risk, or the circumstances that led to the claim.

If a policyholder's claim is rejected, they should first read the rejection letter carefully, keep all relevant documents, and if they believe the rejection is unfair, they can seek a review through the insurer's internal grievance redressal mechanism, approach the Insurance Ombudsman, or file a complaint with the appropriate consumer commission.
