Turkey extends company loss calculation relief to 2028
Turkey has extended a temporary accounting rule for companies until 1 January 2028.
It applies to calculations under Article 376 of the Turkish Commercial Code, which covers companies that have lost capital or may be unable to pay their debts.
Eligible companies may leave out exchange-rate losses on certain foreign-currency obligations that have not yet been paid.
They may also exclude half of specified rental, depreciation and staff costs that accrued in 2020 and 2021.
The change extends the existing rule but does not widen which losses or expenses qualify.
These amounts remain in the companies’ financial statements, and their debts and payment duties do not disappear.
The law’s other requirements remain in place, including calling a general meeting in certain cases of capital loss and assessing whether assets cover debts when insolvency is suspected.
Companies can continue using the temporary calculation rules until the new deadline.
Turkey’s Trade Ministry extended a temporary accounting measure for companies assessing capital loss and over-indebtedness under Article 376 of the Turkish Commercial Code.
A communiqué published in the Official Gazette on 10 October 2026 moved the measure’s expiry date from 1 January 2027 to 1 January 2028.
Companies may exclude specified foreign-exchange losses on outstanding foreign-currency liabilities from those assessments, subject to the rules’ conditions.
The measure also allows half of certain rental, depreciation and personnel expenses accrued in 2020 and 2021 to be excluded from the calculations.
The excluded amounts are not erased from financial statements, and companies’ debts and repayment obligations remain in place.
The extension does not remove companies’ obligations under Article 376, including steps required when losses reach specified levels or over-indebtedness is suspected.
