Mexico's Supreme Court sets when medical negligence claim deadline begins

Mexico's Supreme Court ruled on the deadline for compensation claims involving deaths caused by medical negligence by public servants.

The two-year period starts the day after families learn of the harm, rather than automatically starting when a death certificate is issued.

The case followed the death of a woman at an ISSSTE hospital, after which her husband and daughters sought compensation from the state.

ISSSTE asked the court to review the family's case after a lower court granted them legal protection.

The ruling explains that families must know the harm resulted from negligent or improper conduct and be able to bring a claim.

The decision was approved by six votes to three, and the court's written version is still pending.

The case is to return for reconsideration under the court's interpretation, which aims to protect the family's right to seek justice.
