Former Madhya Pradesh judge challenges compulsory retirement in High Court

Former judge R.K. Srivas has challenged his compulsory retirement in the Madhya Pradesh High Court in Jabalpur.

He joined judicial service in 2000 and was promoted to the higher judicial service in 2016.

He was retired in April 2018, after about a year and a half in the higher service, during which he says he was transferred four times, investigated and suspended.

Srivas argues that the rules required 10 years of service or age 50, and that his earlier service as a civil judge and magistrate could not count toward that requirement.

He alleges a rule change made his retirement possible: the service period required for compulsory retirement was reduced from 20 years to 10 shortly before he was retired, while the age threshold stayed at 50.

The High Court has appointed a senior lawyer to assist it with the case, and the judges have not yet ruled on Srivas’s claims.

The next hearing is scheduled for November 16.
