Brazil Supreme Court makes Oswaldo Eustáquio a defendant in Jan. 8 case
Brazil’s Supreme Court unanimously accepted a criminal case against blogger Oswaldo Eustáquio over alleged criminal association linked to the events of Jan.
8, 2023.
The case concerns camps set up outside the Army headquarters after Luiz Inácio Lula da Silva won Brazil’s 2022 election.
Prosecutors say Eustáquio took part in the camps and posted about them on social media, as part of efforts to discredit the electoral system and attack democratic rule.
The court’s decision allows the case to proceed but does not decide whether he is guilty.
Eustáquio was arrested and released, then moved to Spain, where he is considered a fugitive; in December 2025, a Spanish court rejected Brazil’s extradition request, citing political motivation in the investigation.
He will next have a chance to present a preliminary defence, followed by witness hearings and his questioning as the court gathers evidence.
The defence and prosecution will then make further submissions before a final judgment.
Brazil’s Supreme Federal Court unanimously made blogger Oswaldo Eustáquio a defendant on a charge of criminal association linked to the January 8, 2023 events.
The court’s First Panel accepted that prosecutors had presented enough evidence to open a criminal case.
The decision does not determine whether Eustáquio is guilty or innocent.
