São Paulo prosecutors sue over post targeting Erika Hilton
São Paulo prosecutors have sued state deputy-elect Eduarda Campopiano over a social media post about federal deputy Erika Hilton.
Campopiano made the post after Brazil’s first-round election, celebrating her vote and referring to Hilton as a “biological man.”
The prosecutor says the wording discriminated against trans women and caused collective harm.
The lawsuit seeks R$100,000 in damages, a public apology and a 50-hour course on inclusion and preventing discrimination.
It also asks a judge to bar Campopiano from making further statements considered transphobic, with a penalty if she does.
The prosecutor argues parliamentary immunity does not apply because Campopiano had not yet been sworn in as a state deputy when she posted.
The court will decide whether to grant the requested penalties; no ruling is reported.
São Paulo prosecutors filed a civil lawsuit against state deputy-elect Eduarda Campopiano over a post referring to federal deputy Erika Hilton as a “biological male.”
The lawsuit seeks at least R$100,000 in collective damages, a public retraction and other measures.
The post was made on X on October 5, the day after the first round of the 2026 elections.
Prosecutors say the post discriminated against trans women and that parliamentary immunity does not cover personal attacks unrelated to official duties.
Campopiano said she intended the post as a political provocation and denied seeking to promote discrimination, violence or hostility.
The case has yet to be considered by a court, and Campopiano has not been convicted.
