Supreme Court sends Azam Khan’s ED arrest plea to Allahabad High Court
The Supreme Court sent Samajwadi Party leader Azam Khan’s arrest challenge to the Allahabad High Court on Thursday.
The case concerns his arrest by the Enforcement Directorate outside Rampur jail on October 31, shortly after he was released on bail in another case.
The ED case relates to alleged irregularities in land purchases for Jauhar University.
Khan’s lawyers say he was arrested unlawfully and was not given written grounds for his arrest; these claims have not been decided by the court.
The High Court was asked to hear the case on November 16, and Khan’s lawyers may add requests for other forms of relief.
The Supreme Court did not rule on whether the arrest was legal or on the merits of the case.
Khan says he has faced 95 criminal cases since 2017, and argues that the latest arrest is part of a pattern keeping him in custody; the allegations of political motivation remain his claims.
The Supreme Court on November 5 directed Azam Khan to take his bail plea in a fresh Enforcement Directorate case to the Allahabad High Court.
It asked the High Court to give the matter priority and list it on November 16.
