Dresden court orders Volksbank to compensate real estate fund investor
A Dresden court ordered Volksbank Dresden-Bautzen to pay compensation to a customer who invested in an open-ended property fund.
The customer and their spouse put €14,000 into the UniImmo Wohnen ZBI fund after a bank adviser recommended it in 2018.
When they sought to withdraw their investment, the fund’s price fell and the sale brought in about €10,777.
The court said the bank had not shown that it clearly explained risks, including the withdrawal period and the possibility that withdrawals could be suspended.
The court awarded about €3,223, but did not grant compensation for lost potential profits.
The ruling is not final, and it is the fourth decision in favour of bank customers in disputes over the fund’s sale by cooperative banks.
Other legal cases are continuing, including a question about these funds’ risk ratings referred to the European Court of Justice and a model proceeding that has been allowed to go ahead.
The Dresden Regional Court ordered Volksbank Dresden-Bautzen to pay a customer about €3,223 in damages over advice on a real estate fund.
The customer and their spouse invested €14,000 in UniImmo Wohnen ZBI after a bank adviser recommended it.
The court found that the bank had not shown it adequately explained risks including holding periods, notice periods and possible losses.
It said a reference to the product information sheet alone was not enough to prove adequate advice.
The ruling, dated 10 September 2026, is not yet legally binding.
