Italian court rejects Fincantieri's €1.9m claim against Monfalcone
A regional administrative court in Friuli Venezia Giulia rejected Fincantieri's €1.9 million claim against the municipality of Monfalcone in northeastern Italy.
The company sought damages after the municipality refused permission for night work that would exceed noise limits.
The work was intended to prepare the shipyard for installing two new cranes.
The court said municipalities can weigh companies' production needs against residents' right to quiet and rest at night, and that permission to exceed noise limits is not automatic.
It also said an earlier permission for different work did not guarantee a new exemption; the request to overturn the refusal was no longer actionable because the work had been completed.
Fincantieri plans to appeal to Italy's Council of State.
