Turkish appeals court rejects worker’s request to return to job

A sports coordinator at a private education institution in Bursa, Turkey, was dismissed after calling managers incompetent at a meeting attended by managers and guests.

The worker said the contract ended while they were on medical leave and asked a labor court to order their return.

That court found the dismissal invalid and ordered the worker reinstated.

The institution appealed, arguing that the worker had been warned repeatedly about their way of speaking to colleagues.

The regional appeals court said the comments went beyond ordinary criticism and could disrupt the workplace relationship.

It found the words were not serious enough to justify immediate dismissal, but did provide a valid reason to end the employment.

The court overturned the reinstatement order and rejected the worker’s case, so the request to return to the job was denied.

Although these statements were not serious enough to give the employer just cause for termination, under objective conditions it is clear that the employer could not be expected to continue the employment relationship.
