Allahabad HC Rules on Tenancy Agreement Jurisdiction
The Allahabad High Court made an important decision about rent laws in Uttar Pradesh.
The court said that even if there is no written agreement between a landlord and a tenant, the rent authority can still help the landlord if they want to evict the tenant.
The court explained that the law was made this way on purpose, so landlords aren't treated unfairly just because they don't have the right papers.
This decision helps landlords who might have trouble with tenants but don't have a written agreement.
Allahabad High Court ruled that absence of written tenancy agreement does not bar jurisdiction of rent authority.
Rent authority can entertain landlord's application for eviction even without written agreement or furnished tenancy particulars.
Court emphasized that legislature's omission of 'fatal consequences' from Central Model Tenancy Act ensures landlords' rights are protected.
Jurisdiction of rent authority under UP Act of 2021 is not limited to cases with written agreements.
Court considered multiple provisions and context of the law to determine legislative intent.
