Allahabad High Court Upholds Relief for CISF Constable
A head constable in the CISF was removed from his job because he was accused of murder and put in jail for a few months.
He was not convicted, and the court said that just being in jail for a crime you didn't get convicted of is not a good enough reason to fire someone.
The court decided that the removal was unfair and told the authorities to give him his job back.
They also said that the authorities should decide about paying him his dues according to the rules.
The Allahabad High Court upheld the relief of a CISF constable who was removed from service for alleged involvement in a murder case.
The court ruled that mere incarceration without conviction cannot be a ground for removal from service.
The constable was incarcerated for around four months before getting bail and remained under suspension.
The court observed that the initiation of disciplinary proceedings and the removal order were without factual and legal basis.
The court directed the concerned authority to decide on the payment of dues as per applicable rules.
