Delhi High Court Rebukes Meta in Trademark Battle
The Delhi High Court recently scolded Meta for not quickly accepting the money awarded in a trademark case against a Bengaluru bakery.
The court had earlier ordered the bakery, Ehrlich Foods, to stop using names like 'FACEBAKE' and 'FACECAKE' because they were too similar to Meta's 'FACEBOOK' trademark.
The bakery has since changed its name to 'BUNCAKE' and has 53 outlets in Bengaluru.
The court noted that Meta was slow to provide bank details for the awarded money, which was only paid in September 2023, more than three years after the order.
The court also said that the bakery has been complying with the order and there was no deliberate disobedience.
Meta had asked for more penalties, but the court said these requests were not valid.
Delhi High Court rebuked Meta for not promptly accepting awarded damages in a trademark case.
Ehrlich Foods was ordered to stop using 'FACEBAKE' and 'FACECAKE' and pay Rs 50,000 in damages plus legal costs.
The bakery has since changed its name to 'BUNCAKE' and complies with the court's permanent injunction.
Meta sought additional penalties, but the court found these requests misconceived.
The court noted Meta's lack of initiative in providing bank details for the awarded money.
