Madras HC Quashes FIR Against Amit Malviya
The Madras High Court has decided to cancel a case against Amit Malviya, a leader from the Bharatiya Janata Party (BJP).
This case was about a video he shared on social media.
The video showed Udhayanidhi Stalin, the Deputy Chief Minister of Tamil Nadu, giving a speech.
In the speech, Stalin said that Sanatana Dharma, which is a term often linked to Hinduism, should be eradicated, like how we get rid of diseases.
Malviya shared this video and asked if it meant calling for the genocide of 80% of India's population who follow Sanatana Dharma.
The police filed a case against Malviya for allegedly spreading hate speech.
However, the court said that Stalin's words were actually hate speech, and Malviya was just asking a question.
The court also mentioned that it was unfair that people who react to hate speech are punished, while those who start it are not.
The BJP has demanded that Udhayanidhi Stalin be removed from his post and a case be filed against him for his hate speech.
Madras High Court quashed an FIR against Amit Malviya for sharing a video of Udhayanidhi Stalin's speech.
Stalin's speech called for the eradication of Sanatana Dharma, comparing it to diseases like dengue and COVID-19.
Malviya questioned whether Stalin's statement implied genocide against 80% of India's population who follow Sanatana Dharma.
The court found that Stalin's speech amounted to hate speech and that Malviya's post was a question, not hate speech.
The BJP demanded Udhayanidhi Stalin's removal as Deputy CM and filing of a case against him for hate speech.
