Supreme Court Upholds Compensation for Illegal Homestay Arrest

Supreme Court Upholds Compensation for Illegal Homestay Arrest

A homestay owner named Vishal was arrested after a visitor was allegedly sexually assaulted at his property.

The court noted that Vishal was not at the property when the alleged assault happened.

It also found that police had not shown a lawful reason to arrest him at that time.

The Karnataka High Court therefore said the arrest was illegal.

It ordered the state to pay Vishal Rs 5 lakh for losing his freedom unlawfully.

The Supreme Court agreed with that decision.

However, the payment does not mean the court declared Vishal innocent.

The police may still investigate whether he had any role in the case.

The FIR against him was not cancelled.
