Gujarat HC restricts HRC in property disputes
The Gujarat High Court recently made a big decision about the Gujarat State Human Rights Commission.
The court said that the Commission should not get involved in private property disputes between people.
The court explained that these kinds of disputes are for civil courts to handle, not the Human Rights Commission.
The court also gave some guidelines to the Commission to make sure it only deals with real human rights issues.
This all happened because a woman named Sharda Patel tried to use the Commission to settle a property dispute with her relatives, even though she had already filed a case in a civil court.
The court said this was not the right way to use the Commission's powers and stopped the proceedings.
The Gujarat High Court quashed proceedings initiated by the Gujarat State Human Rights Commission in a property dispute case.
The court directed the HRC to conduct primary scrutiny to ascertain any violation of human rights before taking suo motu cognizance.
The HRC was instructed not to entertain complaints involving private civil disputes unless there is demonstrable state action resulting in a human rights violation.
The court noted that the HRC acted in haste and mechanically entertained the complaint, leading to a settlement without judicial adjudication.
The proceedings against the petitioners before the HRC were quashed and set aside by the High Court.
