Rajasthan High Court Quashes FIR for Lack of Abetment Evidence
The Rajasthan High Court recently decided that just blaming someone in a suicide note for problems caused by legal fights is not enough to prove they encouraged the suicide.
The court canceled the police report (FIR) against four people accused of making someone in their family commit suicide.
The court said that general complaints or ongoing legal disputes do not automatically mean someone was pushed to suicide.
They explained that to prove abetment, there must be clear evidence that the accused wanted the person to die.
The court also noted that the person who died had other problems like family fights and money troubles, which made the link between the legal fight and the suicide weaker.
Because of this, the court decided the police report did not show enough proof of abetment and canceled it.
Rajasthan High Court quashed an FIR against four persons accused of abetting suicide due to lack of evidence.
The court ruled that mere allegations in a suicide note about litigation problems do not constitute abetment.
Key legal principles of mens rea (guilty mind) and proximate link were emphasized for proving abetment.
The court noted a three-month gap between the complaint and the suicide, weakening the causal link.
Other factors like family disputes and financial problems were also considered in the deceased's suicide note.
