Bombay HC Orders ED to Share Interest with Armed Forces Fund
The Bombay High Court has decided that the Enforcement Directorate (ED) should give half of the interest earned on ₹46.5 crore to a fund that helps families of soldiers who have died in battle.
This money was originally deposited by the ED as part of a case involving Shapoorji Pallonji & Company Ltd (SPCL).
The court felt it was important to support the families of soldiers who have made the ultimate sacrifice for the country.
The case started because the ED thought the money SPCL paid for land was connected to a crime, but the court disagreed and said the money should be returned to SPCL.
The interest earned on the deposited amount will now be shared with the Armed Forces Battle Casualties Welfare Fund to help those in need.
The Bombay High Court ordered the Enforcement Directorate to share 50% of the interest accrued on ₹46.5 crore with the Armed Forces Battle Casualties Welfare Fund.
The court dismissed the ED's appeal against a 2019 order that set aside the attachment of assets worth ₹141.50 crore belonging to Shapoorji Pallonji & Company Ltd (SPCL).
The HC directed the deposited amount to be returned to SPCL and instructed that half of the interest accrued should go to the welfare fund.
The case involved payments made by SPCL to Nilesh Thakur and his companies for land purchase, which the ED claimed were 'proceeds of crime'.
The court acknowledged the sacrifices of Indian soldiers and the need to support their families, leading to the decision to share the interest with the welfare fund.
