Courts Rule in Favor of COVID-19 Medical Claims
Two high courts in India recently made important decisions about COVID-19 related medical expenses.
In Telangana, a retired government employee and his wife were treated for COVID-19, but their employer, All India Radio, only paid a small part of their medical bills.
The employee had to go to court to get the rest of the money.
The court said the employer should have paid the full amount and even scolded them for not dealing with the hospital that overcharged the couple.
In another case in Allahabad, a widow asked for compensation because her husband, a teacher, died from COVID-19 after working on election duty.
The local government said no because they didn't have a COVID-19 test report.
But the court said the test report was real and told the government to give the widow the money she asked for.
Both courts decided that people should get the help they need during tough times like the pandemic.
Telangana High Court upheld full reimbursement for a retired employee's COVID-19 treatment, criticizing the employer's denial based on technicalities.
Allahabad High Court directed authorities to reconsider a widow's plea for Rs 30 lakh ex gratia compensation after her husband died from COVID-19 post-election duty.
In both cases, courts emphasized the importance of providing support during the pandemic and criticized the rigid application of rules.
The Telangana case involved overcharging by a hospital and the employee's failure to inform the department about hospitalization due to an emergency situation.
The Allahabad case highlighted the need for proper documentation and the court's rejection of the district magistrate's contention that the widow's claim was invalid due to lack of proof.
