Punjab and Haryana HC Modifies Order on Gurgaon Plot Dispute
There is a big fight over a piece of land in Gurgaon worth over Rs 700 crore.
The Haryana Shahri Vikas Pradhikaran (HSVP) and a real estate company, Lekh Buildtech, are arguing about the size of the land and how much money should be paid.
The company says the land is smaller than what was promised, while HSVP wants the company to pay the full amount.
A lower court said HSVP had to pay back some money, but a higher court changed that rule.
Now, instead of paying back the money, HSVP has to promise not to sell or give away the land until the fight is over.
The land is not being used right now because of this fight.
The Punjab and Haryana High Court modified an earlier order, allowing HSVP to avoid depositing Rs 123.77 crore as security.
The court ruled that a charge should be created over the suit property instead of requiring separate security.
The dispute involves a 3.53-acre plot in Gurgaon, with Lekh Buildtech claiming the actual size is 3.14 acres.
HSVP issued a Letter of Interest (LoI) in May 2022, with a final sale consideration of Rs 495.11 crore.
The First Appellate Authority ordered HSVP to maintain the status quo and furnish security to safeguard the respondent's interests.
