IBC Amendment Bill Seeks Faster Resolutions
A special group in the Indian Parliament, called the Lok Sabha committee, has been looking at a new law called the Insolvency and Bankruptcy Code (Amendment) Bill, 2025.
This law is about helping companies that are in financial trouble.
The group, led by a member of the BJP named Baijayant Panda, has finished their report and shared it with the rest of the Parliament.
The report suggests changes to make the process of helping these companies faster and more transparent.
The law aims to make it easier for investors to buy troubled companies and to reduce delays in fixing these companies.
The committee also talked about making rules for dealing with companies that have problems in other countries and suggested that the people who help these companies should not be the same ones who try to sell them.
Another group in Parliament has also said that the current system has some problems, like not enough judges and uncertainty in the process, which need to be fixed.
The new law is one of the biggest changes to the original Insolvency and Bankruptcy Code, which was first introduced in 2016.
A Lok Sabha committee tabled its report on the Insolvency and Bankruptcy Code (Amendment) Bill, 2025, recommending faster tribunal admissions and clearer rules for creditor-led and cross-border insolvency.
Key proposals include statutory timelines for case disposal, modifications to the Committee of Creditors' decision-making process, and a new framework for group insolvency tailored to India's institutional realities.
The committee suggested moving away from the automatic appointment of resolution professionals as liquidators and proposed a 3-month deadline for the National Company Law Appellate Tribunal to pass orders.
The average time to conclude a resolution process under the IBC is rising, with 603 days taken to complete 1,300 corporate insolvency resolution processes in the July-September 2025 quarter.
The committee recommended codifying the 'Clean Slate' principle and decriminalizing sections 74 and 76 of the IBC to ensure accountability while avoiding over-criminalization of procedural errors.
