Bombay HC Fines HDFC Ergo for Challenging Disabled Air India Crew's Compensation
The Bombay High Court recently made a big decision.
They told a company called HDFC Ergo that they have to pay ₹2 lakh because they tried to challenge a compensation award given to an Air India worker named Adil Lutfi Peters.
Peters was in a bad accident in 2014 that left him very hurt and unable to work.
The court said that the company didn't have a good reason to challenge the money given to Peters.
They also said that the court that gave the money in the first place did a good job.
So, HDFC Ergo has to pay Peters extra money for making him go through the court process.
Bombay High Court imposed ₹2 lakh costs on HDFC Ergo for challenging a MACT compensation award to an Air India cabin crew member.
The MACT awarded ₹45.25 lakh to Adil Lutfi Peters for 100% permanent disability caused by a 2014 road accident.
HDFC Ergo argued that the Tribunal failed to properly appreciate the evidence and ignored contradictions in Peters' testimony.
The High Court dismissed the appeal, stating that minor inconsistencies in witness statements do not undermine the case.
The court emphasized that the adequacy of evidence cannot be examined in writ jurisdiction and that the Tribunal's primary function is to determine just and fair compensation.
