HC Refuses to Interfere with NGT Order on Ludhiana Park Restoration
The Punjab and Haryana High Court decided not to change a decision made by the National Green Tribunal (NGT).
The NGT had said that a park in Ludhiana should be restored to how it was originally, which means a public library built inside the park might need to be removed.
The city government argued that the library only uses a small part of the park and doesn't harm the environment.
They also said a state rule allows up to 15% of a park to be used for things like kiosks.
But the court said the NGT had already looked at the facts and decided, so the High Court shouldn't change that.
The city government can still appeal to the Supreme Court if they want to challenge the NGT's decision.
Punjab and Haryana High Court declined to interfere with NGT's order for restoring Ludhiana park to its original form.
NGT's order requires the demolition of a public library built inside the park's green area.
Ludhiana Municipal Corporation argued that only 7.6% of the park's area was used for the library and no trees were cut.
The civic body cited a 2021 state notification permitting up to 15% of a park's area as hard surface for facilities like kiosks.
High Court observed that the NGT had already examined the factual matrix and it would not be proper to revisit those findings in judicial review.
