HC Commutes Death Sentence in Brother's Murder Case
A man named Ashok Kumar was originally sentenced to death for killing his younger brother, Deepak, and cutting off his head.
The crime happened in Tohana, Fatehabad, because of a long argument over property.
The court decided that Ashok should not be executed but should spend at least 20 years in prison instead.
The court found that Ashok had a strong grudge against Deepak because their mother left a house to Deepak in her will.
The court also said that the investigation was not done well and that there was not enough evidence to prove that Ashok was the last person seen with Deepak.
The court considered Ashok's age, health problems, and the fact that the crime was about personal revenge, not a threat to society, when deciding to change the sentence.
Ashok Kumar was sentenced to life imprisonment with a minimum of 20 years for murdering and decapitating his brother Deepak.
The crime was motivated by a long-standing property dispute and personal revenge.
The court found that the investigation was poorly conducted and lacked sufficient evidence.
The court considered Ashok's age, health issues, and the nature of the crime in commuting the death sentence.
The court enhanced the fine from Rs 20,000 to Rs 5 lakh and ordered that Ashok shall not be released until he completes 20 years of actual sentence.
