Supreme Court Rejects Patna HC Order on Narco-Analysis Tests
Imagine the police wanted to use a special test on everyone accused of a crime, called a narco-analysis test.
The Supreme Court, like the highest judge, said no.
They said people can't be forced to take this test.
However, if someone *wants* to take it during their trial, and they agree freely, it could be allowed.
The court also said the test results aren't always reliable enough to decide if someone is guilty and they shouldn't be the only reason someone is convicted.
So, the Supreme Court made sure that the government follows rules when using these types of tests.
The Supreme Court ruled an accused doesn't have an absolute right to a narco-analysis test.
The Court clarified such tests may be allowed during trial with free consent and safeguards.
The ruling addressed a Patna High Court order permitting narco-tests on all accused during investigation.
The Supreme Court cited the Selvi v State of Karnataka case, which addressed Article 21.
The Court emphasized the suspect evidentiary value of narco-analysis tests.
