Court: UAPA Accused Must Challenge Sanction at Trial
Three people accused of breaking the law asked a court to review the permission they needed to be prosecuted before their trial started.
However, the court said they couldn't do that.
The High Court agreed the permission should be reviewed during the main trial, not beforehand.
The court said the trial judge made the correct decision and pointed to other cases that support this rule.
Now, the accused will have to wait until the trial to question if the police followed all the rules when they got permission to prosecute them.
Telangana High Court dismissed a UAPA accused's appeal.
The accused sought to challenge the validity of their prosecution sanction before trial.
The court ruled such challenges must occur during the trial stage.
The case stems from a 2022 UAPA case investigated by NIA.
The court cited precedent from the Supreme Court.
