HC voids tax notice issued to deceased
The Allahabad High Court ruled that an income tax notice sent to a deceased person is invalid from the start.
The court said this kind of notice can't be fixed later by naming the person's legal heir.
The case involved a woman whose husband died in 2024.
The tax department sent a notice in 2025 about some money her husband was supposed to have paid for a flat.
The court said the notice was wrong because it was sent to a dead person and can't be made right.
The court also suggested that the government should change the law to prevent such problems in the future.
The Allahabad High Court ruled that an income tax reassessment notice issued in the name of a deceased person is void from the beginning.
The notice was issued to Sanjay Dubey, who died in January 2024, and his widow Asha Dubey was later named as the legal heir.
The tax department claimed the notice was about undisclosed cash transactions of Rs 27.44 lakh related to the purchase of a flat.
The court held that a valid notice under Section 148 of the Income Tax Act is necessary for reassessment proceedings.
The court urged Parliament to consider amending the law to address legislative gaps exposed by such cases.
