SC Prioritizes National Security Over Individual Rights
The Supreme Court of India said that the rights of individuals are not always the most important thing, especially when it comes to the security and unity of the country.
They were talking about a case where a train derailed in 2010 and many people died.
The court said that in such serious cases, the focus should be on national security and not just on the rights of the people accused of the crime.
They also said that the trial should be done quickly and that bail should not be given easily in such serious cases.
The court wants to balance the rights of individuals with the need to protect the country.
The court also emphasized that the state must ensure speedy trials and that procedural formalities alone are not enough to uphold the principles of a constitutional democracy.
The Supreme Court ruled that individual rights under Article 21 are subordinate to national interest in cases affecting national security or integrity.
The ruling came in an appeal by the CBI against the bail granted to accused in the 2010 Jnaneswari Express derailment case, which resulted in 148 deaths.
The court emphasized that bail should not be granted solely based on individual rights in such serious cases.
The trial court was directed to expedite the trial and report progress every four weeks.
The court balanced the rights under Article 21 with the need to protect national security and sovereignty, and stressed the importance of speedy trials and meaningful justice.
