Patna High Court Grants Bail to Juveniles in Ganja Case

Patna High Court Grants Bail to Juveniles in Ganja Case

The Patna High Court gave bail to two teenagers accused of transporting 65 kg of ganja.

A lower juvenile court and an appeals court had previously refused them bail.

The teenagers were found to be 15 years and 9 months old and 16 years old when the alleged offence happened.

The High Court said children accused of crimes should usually receive bail.

Bail can be refused only if there is a clear risk of criminal influence, danger to the child, or harm to the legal process.

The court said the amount of ganja alone was not enough to keep them in custody.

However, the court was concerned because officials first treated them as adults.

It also questioned how they traveled from Guwahati to Patna without identification, vehicle papers, or a driving licence.

The Patna SSP must investigate these issues within three months.

If the inquiry finds that age-related facts were hidden or falsified, authorities may ask to cancel the bail.
