High Court Revokes FDA Suspension of Navi Mumbai Restaurant
The Bombay High Court said that a restaurant in Navi Mumbai was shut because the food safety agency, the FDA, had put a stop on its licence.
The court found out that the restaurant had actually passed all safety checks and was fully compliant.
Because of this, the court cancelled the stop on the licence.
It also said it might make the FDA pay the restaurant for the money it lost while it was closed.
The court also talked about how the FDA had not acted against some government canteens that were not clean.
The judges want the FDA to be more fair and quick in fixing problems.
Bombay High Court revoked the Maharashtra FDA’s licence suspension of Hotel Pawan Bar and Restaurant after a re‑inspection found 100% compliance.
The court said it would consider imposing costs on the FDA for the restaurant’s losses during the 15‑day suspension.
The FDA had initially suspended the licence on June 30 after a 63% compliance finding, but failed to lift it after a July 14 re‑inspection.
The court also criticised the FDA’s selective enforcement, citing its failure to act against Mantralaya canteens that were deemed 93% compliant.
The bench directed the restaurant to file an affidavit detailing financial losses incurred since July 14.
