Patna High Court Rejects Divorce Claim Over ‘Compromising Position’

The Patna High Court considered a husband’s request for a divorce.

He said he found his wife in a “compromising position” with another man.

He also accused her of treating him cruelly.

The wife denied these claims.

The court said being seen in such a position does not automatically prove that sexual intercourse happened.

Under the law, adultery must involve voluntary sexual intercourse with someone else after marriage.

The court said circumstantial evidence can sometimes prove adultery, but this husband’s claims were not enough.

It also found his cruelty allegations too vague.

The court therefore rejected his appeal and kept the family court’s decision in place.
