Bombay High Court Rules EPFO Needs Notice Before Blocking Payments
The Bombay High Court recently made an important decision about the Employees’ Provident Fund Organisation (EPFO).
The court said that EPFO cannot stop someone from making payments without first giving them a notice and a chance to respond.
This case involved a company called B.T. Kadlag Constructions, which had leased a sugar factory in Nashik.
The factory had some old debts, and EPFO was trying to recover money from the previous owners.
EPFO issued an order to stop the company from paying rent to the bank and instead pay the money to the Recovery Officer.
The company argued that EPFO did not follow the proper steps, like giving a notice and allowing them to explain.
The court agreed and said that EPFO must follow these steps before issuing any such order.
The court also gave the company three weeks to submit a statement on oath.
Bombay High Court ruled that EPFO cannot issue a prohibitory order under Section 8-F of the EPF Act without prior notice and an opportunity to respond.
The case involved B.T. Kadlag Constructions, which leased a sugar factory in Nashik that had defaulted on loan repayments.
EPFO issued a prohibitory order on 22 August 2025, treating the petitioner as a debtor and stopping lease rent payments to the bank.
The High Court acknowledged the priority of provident fund dues but stressed the importance of following the mandatory procedure outlined in Section 8-F.
The court quashed the prohibitory order against the petitioner but allowed it to stand as a notice, giving the petitioner three weeks to file a statement on oath.
