Delhi HC Grants Divorce, Rules Pregnancy Can't Erase Cruelty
The Delhi High Court decided to grant a divorce to a man because his wife had been cruel and abusive to him.
The court said that even though the wife was pregnant once and they had some good times, that didn't make up for the bad things she did.
The man and his wife got married in 2016, but they had a lot of problems.
The man said his wife was mean to him and his mom, threatened to hurt herself, and refused to live with him.
The wife said the man and his family were mean to her and made her leave their home.
The lower court said no to the divorce, but the high court said yes because the man proved his wife was cruel.
The court also said that divorce is not about winning, but about recognizing that the marriage can't be fixed.
The Delhi High Court granted a divorce to a man based on his wife's acts of cruelty and abusive conduct.
The court ruled that pregnancy or temporary reconciliation cannot erase previous acts of cruelty.
The family court had initially dismissed the divorce petition, citing the wife's miscarriage as a sign of a harmonious relationship.
The high court found that the wife's repeated humiliation, insults, threats of self-harm, and refusal to cohabit constituted mental cruelty.
The court urged both parties to maintain civility in future interactions, particularly in any pending or future proceedings concerning maintenance or other ancillary reliefs.
