Courts Uphold ED Actions in Money Laundering Cases
Two different high courts in India have recently made decisions about cases involving the Enforcement Directorate (ED), which is a government agency that investigates money laundering.
In one case, the Indore Bench of the Madhya Pradesh High Court dismissed a plea by Nitin Shambhukumar Kasliwal, the former head of a textile company, who was challenging a search and seizure conducted by the ED.
The court said that Kasliwal could challenge the ED's actions through other legal processes.
In another case, the Bombay High Court refused to cancel a criminal case and a money laundering case against Rashmi Saluja, the former head of Religare Enterprises.
The court said there was enough evidence to justify the prosecution.
Both courts upheld the ED's actions and dismissed the challenges.
Madhya Pradesh High Court dismissed Nitin Shambhukumar Kasliwal's plea challenging ED search under PMLA.
Bombay High Court refused to quash FIR and ECIR against Rashmi Saluja in ESOP money laundering case.
Both courts upheld ED's actions, finding no substance in the challenges.
Kasliwal alleged ED's action was illegal and arbitrary, but the court found alternative statutory remedies available.
Saluja's plea was dismissed due to an abundance of incriminating material collected by the ED.
