Supreme Court Tightens Arrest Safeguards Under Article 22

Supreme Court Tightens Arrest Safeguards Under Article 22

The Supreme Court said police must clearly explain why someone is being arrested.

This explanation must be written and given in a language the arrested person understands.

This rule applies even when the accusation is very serious.

It also applies to cases under special laws.

If police do not follow the rule, the arrest is unconstitutional.

The person must be released immediately, and this release is not the same as bail.

The officer may face a departmental inquiry, and another officer must handle the case.

A new arrest requires approval from a senior officer and a magistrate.
