Supreme Court Tightens Rules For Commercial Use In Residential Areas

Supreme Court Tightens Rules For Commercial Use In Residential Areas

The Supreme Court has explained how authorities should handle businesses operating in residential areas.

If an area is meant only for homes, officials should first seal a property being used for business.

If it is unclear whether an area is residential or commercial, officials should not change its status while the case continues.

A property dispute does not automatically stop officials from sealing a violating premises.

Buildings constructed without approval may also be sealed or demolished under the law.

The court said officials must apply these rules fairly and not target only selected properties.

The court was told that some properties in Bhopal were sealed and then reopened quickly.

Bhopal’s current rules will continue until a new Master Plan is approved with the court’s permission.
