Kerala High Court Restores Vigilance Cases Against Former KCA Office-Bearers
Imagine some people who used to be in charge of a cricket association are accused of doing something wrong when they bought land to build cricket stadiums.
A court had previously said that these accusations weren't serious enough to investigate because the cricket association wasn't using government money and wasn't a public office.
However, a higher court reviewed the case and decided to bring the investigation back.
They said that because of how big and important the cricket association's job is, it should be treated like a public service.
This means the people in charge can be investigated for corruption, even if the association is mostly private and not directly funded by the government.
The investigation will now continue.
The Kerala High Court has restored vigilance cases against former office-bearers of the Kerala Cricket Association (KCA).
The cases are related to alleged irregularities in land deals for constructing cricket stadiums at Edakochi and Thodupuzha.
A Division Bench set aside a 2015 ruling by a Single Bench that had previously quashed these cases.
The Division Bench ruled that the KCA and its officials fall within the ambit of the Prevention of Corruption Act, 1988.
The vigilance probe was initiated following private complaints alleging corruption in KCA's land purchases for stadiums.

Applicability of Prevention of Corruption Act
Former KCA Office-Bearers (as argued in 2015 Single Bench ruling)
The KCA is an autonomous sports body affiliated with the BCCI, not a 'public office,' and its officials cannot be prosecuted as 'public servants.' Their activities lacked a public element as they did not receive government funding.
Kerala High Court Division Bench
The KCA's functions, by their nature and scale, fall within the purview of the Prevention of Corruption Act, 1988, allowing the Vigilance and Anti-Corruption Bureau to continue its investigation.
Nature of Alleged Offense
Former KCA Office-Bearers (as argued in 2015 Single Bench ruling)
The act of purchasing land did not by itself constitute a public duty, and a public element would only arise once the stadium was built and opened for public use.
Kerala High Court Division Bench
The vigilance probe was initiated based on private complaints alleging corruption in the KCA's land purchases for stadiums, and these allegations warrant further investigation under the PC Act.
