Delhi HC Upholds Bata's Trademark Infringement Victory
The Delhi High Court made a decision in a case between two shoe companies, Bata India and Leayan Global.
Bata said that Leayan was using a name, 'POWER FLEX', that was too similar to Batas own trademark, 'POWER'.
The court agreed with Bata and said that Leayan cannot use 'POWER FLEX' because it might confuse people who think it's a part of Batas brand.
However, the court allowed Leayan to keep using a slogan, 'THE POWER OF REAL LEATHER', because it doesn't directly connect to Batas trademark.
The court also said that Leayan didn't have a good reason to use a similar name, and Bata's 'POWER' is a well-known and registered trademark.
The Delhi High Court ruled in favor of Bata India, upholding an order that restrains Leayan Global from using the mark 'POWER FLEX'.
The court found that Leayan's use of 'POWER FLEX' infringed on Batas registered trademark 'POWER'.
Bata's 'POWER' trademark is well-known and associated with its sports and casual footwear.
The court dismissed both Leayan's appeal and Batas request for a broader injunction.
Leayan was allowed to continue using the slogan 'THE POWER OF REAL LEATHER' as it does not mislead consumers or suggest an association with Bata's 'POWER' products.
