ITAT Clarifies Section 54 Tax Relief Despite Section 50C

ITAT Clarifies Section 54 Tax Relief Despite Section 50C

A man named Himanshu Jain sold his house in Ghaziabad for ₹1.10 crore, but the government valued it higher at ₹1.962 crore for tax purposes.

The tax department added ₹86.20 lakh to his capital gains based on this higher value.

However, Jain bought a new flat in Pune and argued he should still get a tax break for reinvesting his money.

The ITAT agreed that even though the higher value was used to calculate his gains, he could still get the tax exemption if he met all the conditions.

They sent the case back to the tax officer to check if Jain really qualified for the exemption.
