Supreme Court Requires Magistrate Permission for Re-Arrest After Quashed Arrest

The Supreme Court explained what must happen before someone can be arrested again.

This applies when the person’s first arrest has been cancelled or quashed.

The investigating agency must explain why it did not provide the arrest reasons the first time.

The reason must be genuine.

The agency must later give those grounds to the person.

A magistrate must examine the situation.

The magistrate must decide that another arrest is necessary.

Without that permission, the investigating agency cannot re-arrest the person under this ruling.
