SAT Reduces Deposit for Sathe and ASTA
The Securities Appellate Tribunal (SAT) has partially helped Avadhut Sathe and his trading school, ASTA, by changing a rule from the Securities and Exchange Board of India (SEBI).
SEBI had earlier said they should give back ₹546 crore and stop them from trading.
But SAT said they only need to deposit ₹100 crore, and then many of these rules will stop.
SEBI said Sathe and ASTA were giving stock tips without being registered and misleading people.
But Sathe and ASTA said the money was used for running the school and paying taxes, and they were not giving stock tips.
SAT's decision means they can continue some activities if they pay the ₹100 crore.
The tribunal also noted that while ₹601 crore was collected, it is not yet decided if it was unlawful.
The academy had created private WhatsApp groups for stock recommendations, with one being a paid channel.
SEBI had conducted searches and seized accounts, but Sathe's advocate argued that the regulator's directions violate constitutional rights and are impossible to comply with.
SAT modified SEBI's interim order, requiring Sathe and ASTA to deposit ₹100 crore instead of the initial ₹546 crore.
Upon compliance, several restrictions, including market access and account freezes, will be lifted.
SEBI had alleged unlawful gains and unregistered advisory services, based on investigations from 2017 to 2025.
Sathe and ASTA denied the allegations, stating funds were used for legitimate purposes and defending their training methods.
SAT's order allows the appeal in part, directing compliance with the deposit and filing an affidavit.
